Information clause on data processing in recruitment
Dear Sir or Madam,
In accordance with Articles 12 and 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR), in connection with the recruitment process at FM WUTEH S.A., we inform you that:
The administrator of candidates’ personal data is Fabryka Mebli WUTEH S.A., located in Toruń, at ul. Gen. Józefa Chłopickiego 6.
The Data Administrator has appointed a Data Protection Officer supervising the proper processing of personal data, who can be contacted via e-mail: iodo@detectio.pl
Candidates’ personal data at FM WUTEH S.A. will be processed for the purpose of conducting recruitment and selecting individuals for employment in available positions.
The Data Administrator does not plan to process candidates’ personal data for any purpose other than that for which it was collected, i.e., for future recruitment, unless the candidate gives their consent. Providing consent is voluntary.
Candidates in the recruitment process have the right to withdraw the consent referred to above at any time by notifying the employer. Withdrawal of consent will not affect the lawfulness of processing carried out on the basis of your consent before its withdrawal.
The basis for processing personal data is Article 6(1)(c) of the GDPR (fulfillment of a legal obligation of the administrator) in connection with Article 221 §1 of the Labor Code of 26 June 1974 (consolidated text, April 2019), and the scope of these data is included in the list of information that an employer may require from a person applying for employment in accordance with the Labor Code.
Providing data by candidates during the recruitment process is necessary to achieve the purposes for which the data were collected. Failure to provide data will result in the inability to consider the candidate's application in the recruitment process.
FM WUTEH S.A., in accordance with applicable law, will process the following personal data of candidates: first name(s) and last name, date of birth, contact details provided by the candidate, education, professional qualifications, and previous employment history if necessary for performing work of a specific type or in a specific position.
FM WUTEH S.A., in order to fulfill its legal obligation related to issuing a referral for a medical examination, will process personal data such as home address and PESEL number, as well as special categories of data such as health information and confirmation of no contraindications to perform work in the position held.
During recruitment, FM WUTEH S.A. will also process candidates’ personal data in the special category concerning health by requiring the presentation of a current medical certificate confirming no contraindications to work in the given position, as well as referrals for examinations forming the basis for issuing such a certificate, pursuant to Article 229 §1 and 3 of the Labor Code.
Data will not be disclosed to external entities, except in cases provided for by law.
The Data Administrator does not intend to transfer candidates’ personal data to a third country or an international organization.
Candidates’ data will be stored for the period necessary to achieve the above purposes, i.e., until the recruitment process is completed, and then, for candidates placed on a reserve list who consented to the processing of their data for future recruitment, after which the data will be promptly deleted.
Candidates have the right to request from the Data Administrator access to their data, rectification, and – subject to legal provisions – deletion, restriction of processing, data portability, objection, and the right to withdraw consent at any time.
Candidates also have the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office.
Candidates’ personal data will not be processed in an automated manner and will not be subject to profiling.
