Information for job applicants
Dear Sir or Madam,
On May 4, 2019, the Act of February 21, 2019, on the amendment of certain acts in connection with ensuring the application of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR) came into force.
Pursuant to Article 22 §1 of the Labor Code, the Employer requests that the job applicant provide personal data including:
- First name(s) and last name,
- Date of birth,
- Contact details provided by the candidate,
- Education, professional qualifications, and previous employment history (these data are required if necessary to perform work of a specific type or in a specific position).
In the event of entering into an employment contract, we will also ask you to provide additional data, including:
- residential address,
- PESEL number, or in its absence – the type and number of an identity document (the identity document may be an ID card, passport, or mID - mObywatel document),
- education and previous employment history, if it was not possible to request these from the applicant earlier,
- bank account number, if the employee has not requested payment in cash,
- other personal data of the employee, as well as personal data of the employee’s children and other immediate family members, if providing such data is necessary due to the employee’s use of special entitlements provided under labor law.
We will request other personal data only when necessary to exercise a right or fulfill a legal obligation.
Additionally, we will process personal data that you voluntarily included in your application documents, considering this equivalent to consent for processing.
Pursuant to Article 22 §5 of the Labor Code, we will require documentation of the candidate’s personal data to the extent necessary to verify them.
We also inform you that in the Personal Questionnaire for job applicants, we will ask for your PESEL number and residential address. This is necessary to fulfill a legal obligation of the data administrator (legal basis: Article 6(1)(c) GDPR) and is related to the need to obtain a medical certificate confirming the absence of contraindications to work in a given position or under specified conditions.
Sensitive personal data, including health information, medical certificates, and referrals for medical examinations, will be processed only by persons authorized to perform such tasks. These persons are obliged to keep such information confidential.
Below we provide a sample statement of consent from the candidate for processing personal data for participation in one or future recruitment processes over the next 12 months.
Such consent is required for processing your personal data in future recruitment processes.
"I consent to the processing of my personal data provided for the purpose of the current recruitment / current and future recruitments over a period of 12 months [1], in accordance with Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR)." Please note that you may withdraw your consent at any time by sending an email to: rekrutacja@wuteh.com.pl with the subject line: “withdrawal of consent”. Withdrawal of consent does not affect the lawfulness of processing conducted before its withdrawal.
